Elected politicians—legislators and, in some systems, members of the executive—can choose to exercise authority themselves or to delegate that authority to any number of agencies. Such delegation of power can occur at the constitutional stage, but is most common at the post-constitutional stage. Two categories of delegation can be distinguished: domestic delegation to agencies within the legislators’ jurisdiction, and international delegation to supranational or international bodies. While some research has been done on domestic delegation, especially in the context of delegation (...) to administrative agencies in the U.S., as well as on delegation to supranational bodies, especially with regard to the E.U., these activities have not been analyzed within a unified framework. This paper attempts to inquire into these issues and provide a general picture of the decision-making process regarding whether to delegate authority and to which body to transfer the authority. The past decade has been a period of rapid change in Central and Eastern Europe. Almost all of these countries have either passed entirely new constitutions or substantially modified the old ones. This is a unique situation in which constitutional delegation of powers can be performed almost simultaneously with post-constitutional delegation. The constitutional process in Israel is very different. It has been underway for fifty years. However, it can also be characterized by simultaneous constitutional and post-constitutional choices. In this paper, we examine such delegation choices in nine countries. We describe the main differences among these countries with regard to delegation of power, try to trace their origins and analyze their effects on delegation of powers. One question raised is what are the ramifications of a quasi-simultaneous constitutional and post-constitutional choice? Have constitutional rules been chosen in anticipation of the necessary compatibility with the rules of international organizations that one wants to join? Has membership in international organizations led to a boost in credibility of those governments concerned? (shrink)

Centralised, compliance-focused approaches to research ethics have been normalised in practice. In this paper, we argue that the dominance of such systems has been driven by neoliberal approaches to governance, where the focus on controlling and individualising risk has led to an overemphasis of decontextualised ethical principles and the conflation of ethical requirements with the documentation of ‘informed consent’. Using a UK-based case study, involving a point-of-care-genetic test as an illustration, we argue that rather than ensuring ethical practice such compliance-focused (...) approaches may obstruct valuable research. We call for an approach that encourages researchers and research communities—including regulators, ethics committees, funders and publishers of academic research—to acquire skills to make morally appropriate decisions, and not base decision-making solely on compliance with prescriptive regulations. We call this ‘ethical preparedness’ and outline how a research ethics system might make space for this approach. (shrink)

Ketamine, a dissociative anesthetic commonly used by US physicians, has recently been shown to be a powerful anti-depressant and is also capable of eliciting transpersonal experiences that can be transformative. Although currently approved in the US only for use as an anesthetic, physicians there can legally prescribe it off-label to treat various psychological/ psychiatric problems and it has been used for these non-anesthetic purposes in Argentina, Iran, Mexico, Russia, and the UK, as well as in the US. The literature on (...) using ketamine psychotherapeutically is reviewed and two case studies using ketamine-enhanced psychotherapy for treating death anxiety in terminally-ill people are reported. The potential importance of beginning formal research on using KEP during end-of-life for those suffering death anxiety is emphasized. (shrink)

We apply Benacerraf’s distinction between mathematical ontology and mathematical practice to examine contrasting interpretations of infinitesimal mathematics of the seventeenth and eighteenth century, in the work of Bos, Ferraro, Laugwitz, and others. We detect Weierstrass’s ghost behind some of the received historiography on Euler’s infinitesimal mathematics, as when Ferraro proposes to understand Euler in terms of a Weierstrassian notion of limit and Fraser declares classical analysis to be a “primary point of reference for understanding the eighteenth-century theories.” Meanwhile, scholars like (...) Bos and Laugwitz seek to explore Eulerian methodology, practice, and procedures in a way more faithful to Euler’s own. Euler’s use of infinite integers and the associated infinite products are analyzed in the context of his infinite product decomposition for the sine function. Euler’s principle of cancellation is compared to the Leibnizian transcendental law of homogeneity. The Leibnizian law of continuity similarly finds echoes in Euler. We argue that Ferraro’s assumption that Euler worked with a classical notion of quantity is symptomatic of a post-Weierstrassian placement of Euler in the Archimedean track for the development of analysis, as well as a blurring of the distinction between the dual tracks noted by Bos. Interpreting Euler in an Archimedean conceptual framework obscures important aspects of Euler’s work. Such a framework is profitably replaced by a syntactically more versatile modern infinitesimal framework that provides better proxies for his inferential moves. (shrink)

Delusions are one of the most classical symptoms described in schizophrenia. However, despite delusions are often emotionally charged, they have been investigated using tasks involving non-affective material, such as the Beads task. In this study we compared 30 patients with schizophrenia experiencing delusions with 32 matched controls in their pattern of responses to two versions of the Beads task within a Bayesian framework. The two versions of the Beads task consisted of one emotional and one neutral, both with ratios of (...) beads of 60:40 and 80:20, considered, respectively, as the “difficult” and “easy” variants of the task. Results indicate that patients showed a greater deviation from the normative model, especially in the 60:40 ratio, suggesting that more inaccurate probability estimations are more likely to occur under uncertainty conditions. Additionally, both patients and controls showed a greater deviation in the emotional version of the task, providing evidence of a reasoning bias modulated by the content of the stimuli. Finally, a positive correlation between patients’ deviation and delusional symptomatology was found. Impairments in the 60:40 ratio with emotional content was related to the amount of disruption in life caused by delusions. These results contribute to the understanding of how cognitive mechanisms interact with characteristics of the task in the context of delusional thinking. These findings might be used to inform improved intervention programs in the domain of inferential reasoning. (shrink)

Axel Hägerström is one of the fairly few, if not the only, Swedish philosophers of international significance— yet, he remains in many ways unknown. A major contribution is his theory on the nature of norms and values, which came to be known as value-nihilism, celebrated by some and vehemently rejected by others: Hägerström was the first who formulated a noncognitivist moral theory and debate still continues about the exact significance, scope and implications of this theory. Together with Adolf Phalén, he (...) was one of the two founders of the so-called Uppsala School. He was also the inspirational source of Scandinavian legal realism. Hägerström can be said to be a significant thinker for three reasons: An extraordinary interpreter of his own time, he left his mark on his contemporaries; his thought continues to suggest interesting and contrasting readings, which is indicated by the fact that he is repeatedly re-read by new generations of scholars; finally, he developed general categories that we still use today to understand the world we now live in. This volume collects seventeen chapters of leading experts on Hägerström's philosophical legacy as well as a number of translations of published as well as unpublished manuscripts, collected on occasion of the centenary of Hägerström's prolusion, 'On the Truth of Moral Ideas'. Unfounded—conspiracy and health—beliefs about COVID-19 have accompanied the pandemic worldwide. Here, we examined cross-nationally the structure and correlates of these beliefs with an 8-item scale, using a multigroup confirmatory factor analysis. We obtained a two-factor model of unfounded (conspiracy and health) beliefs with good internal structure (average CFI = 0.98, RMSEA = 0.05, SRMR = 0.04), but a high correlation between the two factors (average latent factor correlation = 0.57). This model was replicable across 50 countries (total N = 13,579), (...) as evidenced by metric invariance between countries (CFI = 0.96, RMSEA = 0.06, SRMS = 0.07) as well as scalar invariance across genders (CFI = 0.98, RMSEA = 0.04, SRMS = 0.03) and educational levels (CFI = 0.98, RMSEA = 0.04, SRMS = 0.03). Also, lower levels of education, more fear of COVID-19, and more cynicism were weakly associated with stronger conspiracy and health beliefs. The study contributes to knowledge about the structure of unfounded beliefs, and reveals the potential relevance of affective (i.e., fear of COVID-19) and cognitive (i.e., cynicism) factors along with demographics, in endorsing such beliefs. In summary, we obtained cross-cultural evidence for the distinctiveness of unfounded conspiracy and health beliefs about COVID-19 in terms of their structure and correlates. (shrink)

This paper is going to focus on the problem of emotions in technology, in particular in reference to the case of algorithms developed to track early rehospitalizations. In this paper I am going to discuss how phenomenology can support the integration of emotions in technology and how this integration can improve our chances for that “decent survival” that the founder of bioethics, Potter, has envisioned as the main goal of this discipline (Natl Cancer Inst Monogr 13:111–116, 1964; Bioethics, bridge to (...) the future. Prentice Hall, Inc., Englewood Cliffs, p 24, 1971; Ann N Y Acad Sci 196(Art. 4):200–205, 1972; Cancer Res 35:2297–2306, 1975; Global bioethics. Michigan University, 1988). I believe that descriptive phenomenology can be a useful philosophical and psychological approach to improve the moral and emotional intelligence behind machine learning programming (Dreyfus, What computers can’t do: the limits of artificial intelligence. HarperCollins, 1978; The Socratic and platonic basis of cognitivism. AI & Society, Springer, Berlin, 1988) and overcome the risk of ethical opacity implied in programming (Casacuberta, Ethical and technical aspects of emotions to create empathy in medical machines. In Van Rysewik SP, Pontier M (eds) Machine in medical ethics. Springer, New York/Dordrecht, 2015). On the one hand, the ethical aspect of phenomenology would allow us to grasp the predicative and pre-predicative facie of the lived-experiences and their emotional contents. On the other hand, the phenomenological method of research applied in psychology would offer a way to transcribe and interpret data in a responsible and contextualized way. (shrink)

During the 1960s, Howard M. Temin (1934-1994), dared to advocate a "heretical" hypothesis that appeared to be at variance with the central dogma of molecular biology, understood by many to imply that information transfer in nature occurred only from DNA to RNA. Temin's provirus hypothesis offered a simple explanation of both virus replication and viral-induced cancer and stated that Rous sarcoma virus, an RNA virus, is replicated via a DNA intermediate. Popular accounts of this scientific episode, written after the discovery (...) of an RNA-directed DNA polymerase in 1970, tend to describe the reaction to his proposition as ardent opposition. Typically these accounts use a 'molecular biology' standpoint emphasizing the central dogma's part in its rejection. In this article, however, this episode will be examined from a joint perspective of virology and experimental cancer research. From this perspective it is clear that Temin's work was well within the epistemological and methodological boundaries of virology and cancer research. Still, scientists did have reasons to doubt the provirus hypothesis, but these do not seem to be good enough to either justify an account that portrays Temin as a renegade or his ideas as heretical. I would expect many readers of my book to want to agree with either Mark Heller or Alan Sidelle. The very idea of “rational constraints on lexicons” will immediately suggest to many people that either the constraints are of a purely pragmatic nature or there really are no such constraints. I can take some cold comfort in the fact that many philosophers will join me in rejecting, and many others will join me in rejecting, but since I have nothing to (...) offer in place of these positions—except mystification—I’m afraid that few will join me in rejecting both of them. The host of SUSY(supersymmetry) based string theories is considered. Superstrings are comprehended as possible candidates on Quantum Gravity basic objects. It is argued that superstring theories constitute mainly mathematical progress and can reconcile general relativity with quantum field theory at best. Yet they cannot provide the genuine synthesis. Superstring unification of all the four forces at hand is a formal one . It is contended that genesis and proliferation of superstrings can better be described not by philosophy of science (...) models but in terms of modern sociology of science. The formal character of gravity and quantum fields fusion and the lack of experimental verification make the transition to superstring theories ad hoc in Lakatosian standards. Bien qu’étant invérifiable tout autant qu’incritiquable, J* s’avère indispensable à la technologie ; ce que Popper avait d’ailleurs admis à plusieurs reprises. Nous critiquons ensuite le point de vue de David Miller selon lequel il n’est besoin d’aucune thèse métaphysique telle que J*, le critère de démarcation étant le seul principe requis par la science comme par la technologie. BackgroundAlthough patient advocates have developed templates for standard consent forms, evaluating patient preferences for first in human (FIH) and window of opportunity (Window) trial consent forms is critical due to their unique risks. FIH trials are the initial use of a novel compound in study participants. In contrast, Window trials give an investigational agent over a fixed duration to treatment naïve patients in the time between diagnosis and standard of care (SOC) surgery. Our goal was to determine the patient-preferred presentation (...) of important information in consent forms for these trials.MethodsThe study consisted of two phases: (1) analyses of oncology FIH and Window consents; (2) interviews of trial participants. FIH consent forms were analyzed for the location(s) of information stating that the study drug has not been tested in humans (FIH information); Window consents were analyzed for the location(s) of information stating the trial may delay SOC surgery (delay information). Participants were asked about their preferred placement of the information in their own trial’s consent form. The location of information in the consent forms was compared to the participants’ suggestions for placement. Results34 [17 FIH; 17 Window] of 42(81%) cancer patients approached participated. 25 consents [20 FIH; 5 Window] were analyzed. 19/20 FIH consent forms included FIH information, and 4/5 Window consent forms included delay information. 19/20(95%) FIH consent forms contained FIH information in the risks section 12/17(71%) patients preferred the same. Fourteen (82%) patients wanted FIH information in the purpose, but only 5(25%) consents mentioned it there. 9/17(53%) Window patients preferred delay information to be located early in the consent, before the “Risks” section. 3/5(60%) consents did this.ConclusionsDesigning consents that reflect patient preferences more accurately is essential for ethical informed consent; however, a one-size fits all approach will not accurately capture patient preferences. We found that preferences differed for FIH and Window trial consents, though for both, patients preferred key risk information early in the consent. Next steps include determining if FIH and Window consent templates improve understanding. (shrink)

Mu‘tezilî düşünür Amr b. Bahr el-Câhız’ın (ö. 255/869) tercüme faaliyetleri sonucu Antikite (Antik Çağ) Yunanca metinlerden yaptığı aktarımlar canlılar hakkındaki fikirlerini etkilemiştir. Böylece Yunan zoolojisinde ortaya koyulan görüşlere Kitâbü’l-Hayevân eserinde geniş bir şekilde yer vermiştir. Ayrıca diğer eserlerinde az da olsa Yunan düşünürlerin hayvanlar hakkındaki görüşleri mevcuttur. Ancak Yunan zoolojisinden tevarüs eden birikimin Câhız’ın Kitâbü’l-Hayevân eseri olmak üzere hangi bağlamda ve ne düzeyde alımlandığı tam olarak bilinmemektedir. Alımlanan bilgilerin Câhız’ı ne kadar etkilediği ve doğrudan mı yoksa kendi ilmî birikiminin süzgecinden (...) geçirerek mi? Aktardığı net olarak ortaya koyulmamıştır. Buradan hareketle bu çalışmada, Câhız’ın hayvanlar hakkındaki görüşleri temel alınarak Yunan zoolojisinden etki düzeyi ortaya koyulmaya çalışılacaktır. Böylece Câhız’ın “Sâhibu’l-Mantık” lakabıyla bahsettiği Aristoteles (mö. 384-322) başta olmak üzere Galen (ö. 200?) ve Polemon (Aflimun) (ö. 314) gibi Yunan düşünürlerden hangi noktalarda aktarımlar yaptığı üzerinde durulacaktır. Bu bağlamda Câhız’ın Kitâbü’l-Hayevan eseri başta olmak üzere diğer eserlerinde geçen Yunan zoolojisine dair ifadeler açığa çıkarılacaktır. Fakat özellikle Aristoteles’ten yaptığı aktarımlar oldukça fazla olduğundan dolayı Câhız’ın tam olarak anlayamadığı, araştırdığı, doğrudan etkilendiği ve test ettiği bilgiler üzerinde analiz yapılacaktır. Çalışma sonucunda Câhız’ın alımladığı bilgileri bazen doğrudan bazen doğruluğunu araştırarak hatta deney ve gözleme başvurarak aktardığı anlaşılacaktır. (shrink)

Elle déconstruit les conceptions et les gestions du corps. Par cela elle révèle les dimensions et les puissances ignorées du corps. Nous proposons, en nous appuyant sur les travaux fondateurs de M. Bernard, de suivre une ligne conceptuelle des déconstructions du corps susceptible d’éclairer les projets esthétiques de certains chorégraphes contemporains.

Phenomenological Psychopathology: Who, What and How? An analysis of key figures, advancements and challenges 2024, Frontiers in Psychology - Special Issue Ed. by S. Ferrarello, F. Brencio, V. Bizzari, M. Englander.

In recent years it has been convincingly argued that the Church-Turing thesis concerns the bounds of human computability: The thesis was presented and justified as formally delineating the class of functions that can be computed by a human carrying out an algorithm. Thus the Thesis needs to be distinguished from the so-called Physical Church-Turing thesis, according to which all physically computable functions are Turing computable. The latter is often claimed to be false, or, if true, contingently so. On all accounts, (...) though, thesis M is not easy to give counterexamples to, but it is never asked why—how come that a thesis that transfers a notion from the strictly human domain to the general physical domain just happens to be so difficult to falsify. In this paper I articulate this question and consider several tentative answers to it. (shrink)
